Opinions of the General Office of Beijing Municipal People’s Government on the Government’s Purchase of Services from Social Forces

The people’s governments of the districts and counties, the commissions, offices and bureaus of the municipal government, and the municipal institutions:

  In order to implement the Guiding Opinions of the General Office of the State Council on Government Purchasing Services from Social Forces (Guo Ban Fa [2013] No.96), further transform government functions, innovate the supply mode of public services, increase the government’s efforts to purchase services from social forces (hereinafter referred to as government purchasing services), and actively build a fair, high-quality and efficient public service system, combined with the actual situation of this Municipality, we hereby put forward the following implementation opinions on government purchasing services.

First, fully understand the importance of government purchasing services

  The government purchases services by giving play to the role of market mechanism, and handing over the public services directly provided by the government to qualified social forces according to certain methods and procedures, and the government pays them according to the quantity and quality of services.

  (A) the government’s purchase of services is an urgent need to transform government functions. Changing some public services from "direct hosting and direct provision" to "purchasing services and monitoring quality" is conducive to giving full play to the efficiency of the use of financial funds, effectively reducing administrative costs, further improving the level and efficiency of public services, and is of great significance to deepening social reform, promoting the transformation of government functions, and accelerating the construction of an efficient and transparent service-oriented government.

  (B) Government purchase of services is an important way to improve the public service system. In order to effectively solve the problems of lack of public service, insufficient scale, low quality, unbalanced development and weak professionalism in some fields, it is necessary to further strengthen the government’s public service function, and build a multi-level and multi-mode public service supply system by innovating the public service supply model and integrating and utilizing social resources.

  (3) The government’s purchase of services is an important measure to promote the development of social forces. Release effective demand, liberalize market access for public services, innovate service formats, fully mobilize the enthusiasm of social organizations, enterprises and other social forces to participate in social governance and provide public services, and promote their healthy development.

Second, the general idea of government purchasing services

  (1) Guiding ideology.

  We will fully implement the spirit of the 18th National Congress of the Communist Party of China and the Third Plenary Session of the 18th CPC Central Committee, and the series of important speeches by the Supreme Leader General Secretary, especially when inspecting Beijing’s work, accurately grasp the strategic orientation of the capital city, accelerate the transformation of government functions, promote the separation of government affairs from politics and society, further liberalize the market access of public services, reform and innovate the mechanism and mode of public service provision, and promote the establishment of a fair, high-quality and efficient public service system to meet the growing public demand for public services.

  (2) Basic principles.

  1. Clear focus, pay attention to actual effect. Further clarify the government’s public service function, accurately grasp the social public service demand, and focus on the areas where public services are absent, low-level and inefficient. In accordance with the principle of transforming government functions, reducing service costs, and improving service level and efficiency in the use of funds, we will promote the government’s purchase of services and ensure effective results.

  2. Actively promote and steadily implement. Basic public services should gradually increase the purchasing power of the government; Non-basic public services should give more and better play to the role of social forces. Formulate a guiding catalogue for government purchasing services, gradually expand the scope and scale of purchasing services, and guide social forces to participate in service supply in an orderly manner. All district and county governments and departments should reform and innovate the way of providing public services and actively explore new forms of government purchasing services.

  3. Openness and transparency, and competition for the best. Timely publish information such as the guiding catalogue of government procurement services, annual plans and performance evaluation results, and actively accept social supervision. According to the principle of competitive selection, we should choose social forces to undertake the government’s purchase of services, study and formulate policies for the government’s purchase of services that are conducive to the diversification of the subjects, and establish a reward and punishment mechanism for the survival of the fittest.

  4. Coordinate and improve the mechanism. Establish a coordination mechanism between the organization establishment management and the government’s purchase of services. For those who can provide services through the government’s purchase of services, no additional institutions or personnel will be added. We will deepen the organic connection between the government’s purchase of services and the reform of public institutions, promote the rationalization of relations between public institutions and competent departments and de-administration, and timely adjust institutional establishment and funds according to actual conditions.

  (3) Work objectives.

  In 2014, a guiding catalogue of government procurement services was issued, and a basic policy system was initially established to form a unified and effective working mechanism. By 2017, a relatively perfect government procurement service system will be established, and an efficient and reasonable public service resource allocation system and supply system suitable for the economic and social development level of this city will be formed, and the level and quality of public services will be significantly improved.

Three, actively and steadily carry out the work of government purchasing services.

  (a) the purchase content.

  The contents of services purchased by the government are public services, transactional management services and auxiliary services needed to perform government duties, which are suitable for market-oriented provision and can be undertaken by social forces. Public service projects in areas closely related to safeguarding and improving people’s livelihood should be given priority consideration. Public services that should be provided directly by the government and are not suitable for social forces, as well as service items that are not within the scope of government duties, shall not be purchased from social forces.

  The contents of services purchased by the government shall be subject to guiding catalogue management, and dynamically adjusted according to the level of economic and social development and the demand for public services. In principle, services that are suitable for social forces to undertake within the scope of the guidance catalogue should be provided by government purchasing services.

  (2) the purchaser.

  The main bodies of government purchasing services are administrative organs at all levels and institutions with administrative functions according to the civil service law, as well as group organizations that are included in the administrative establishment management and whose funds are borne by the finance. Other organs and institutions use financial funds to purchase services with reference to the implementation.

  (3) Undertaking the main body.

  The main bodies that undertake the government’s purchase of services include social organizations registered in the civil affairs department according to law or exempted from registration with the approval of the State Council, as well as enterprises, institutions and other social forces registered in the industrial and commercial administration or industry authorities according to law. Eligible institutions can also serve as the undertaker, but they should compete openly and equally with social forces.

  The undertaker should have the ability to bear civil liability independently, have the facilities, personnel and professional technical ability necessary for providing services, have a sound internal governance structure, financial accounting and asset management system, have a good social and commercial reputation, have a good record of paying taxes and social insurance according to law, and meet other conditions recognized by the registration administration department according to law. The specific conditions of the undertaking entity shall be determined by the purchasing entity in conjunction with the financial department according to the content of purchasing services, but no restrictions unrelated to services shall be attached.

  (4) purchase procedures.

  Departments and units with the demand for purchasing services should put forward the projects of government purchasing services when compiling the annual budget, compile the annual project budget, and release the annual plan to the society. The service items within the scope of government procurement should be purchased in strict accordance with the government procurement process; Services outside the scope of government procurement can be purchased with reference to the relevant provisions of government procurement, or by contract or entrustment. The purchaser shall sign a contract with the undertaker to supervise the implementation of the project; The undertaker should strictly fulfill the contractual obligations, complete the service project tasks on time, ensure the service quantity, quality and effect, and prohibit subcontracting.

  (5) Budget management.

  The funds needed by the government to purchase services adhere to the principle of "fixing fees according to the matter", and are included in the budget of the main purchasing department in accordance with the current budget management measures, and no special funds are set up separately; Adhere to the principle of "fees are transferred with events", and if the original service items are converted into government-purchased services, the original relevant expenditure budget will be adjusted in time.

  (6) Performance management.

  The purchaser should evaluate the performance of the services provided by the undertaker in terms of quantity, quality and satisfaction of the clients. The financial department should supervise, inspect and evaluate the efficiency of the use of government-purchased service funds in key areas and key projects. Give full play to the role of clients and third parties in determining the purchase content and performance evaluation, and establish a credit system for social forces to undertake government purchase of services.

Fourth, safeguard measures

  (1) Strengthen organizational leadership.

  Strengthen the organization and leadership of the government to purchase services, and establish a city-wide overall coordination mechanism in accordance with the principle of "unified leadership of the government, leading by the financial department, and division of labor and cooperation among business departments", so as to form a work pattern of individual responsibility and joint management, and ensure the standardized and orderly development of work.

  (2) Clear division of responsibilities.

  The relevant departments of the municipal government shall, according to the division of responsibilities, carry out in-depth research, listen carefully to the opinions and suggestions of departments and units with the demand for purchasing services, and further study and refine the policies and measures for the government to purchase services. The financial department is responsible for taking the lead in establishing and perfecting the system of government purchasing services, formulating measures for the budget management of government purchasing services, organizing the compilation and publication of the guiding catalogue of government purchasing services, and doing a good job in the budget fund management and performance evaluation of government purchasing services. The organization department is responsible for formulating the organization management measures that are connected with the government’s purchase of services and participating in the compilation of the guiding catalogue of government’s purchase of services. The competent departments of civil affairs, industry and commerce administration and industry are responsible for formulating the standards for undertaking the main conditions, and incorporating the service quality and effect into the work content of social organization evaluation and annual inspection. Civil affairs and social construction departments are responsible for studying and formulating specific policies on government purchasing services to promote the development of social organizations. The supervision and auditing departments are responsible for strengthening the supervision and auditing of the government’s purchase of services. Departments and units with the demand for purchasing services should establish and improve relevant work systems, conscientiously organize and implement the work, and conduct supervision, management and performance evaluation on the purchased services.

  District and county governments should conscientiously implement the work of government purchasing services, formulate specific implementation opinions and measures in light of local conditions, compile the catalogue of government purchasing services in the region according to the scope of powers, and report it to the Municipal Finance Bureau for the record. The Municipal Finance Bureau shall, jointly with relevant departments, strengthen the guidance and supervision of the government’s purchase of services in all districts and counties, and actively promote the smooth development of related work.

  (3) Do a good job in publicity and guidance.

  All district and county governments and departments should widely publicize the purpose, significance and related requirements of government purchasing services to the public, do a good job in policy interpretation, strengthen the guidance of public opinion, fully mobilize the enthusiasm of social forces, and actively create a good social atmosphere.
